News has come through that the appeal against the original decision not to allow the two houses on land at Mill Lane has been granted – i.e. the developers have been given permission to go ahead.

The full text of the appeal decision by Stephen Normington BSc DipTP MRICS MRTPI FIQ FIHE can be seen by clicking on the link below the picture.

Neighbourhood Plan

The appeal document recognises the existence and weight of the Neighbourhood Plan (which the developers in their submission apparently claimed, wrongly, has not yet been "made"). However the presumption in favour of granting permission where the local authority cannot demonstrate their five-year housing supply still outweighs other considerations.

Audlem Parish Council comments:-

"Obviously we are disappointed, but yet again Cheshire East's lack of a Local Plan and 5-year Housing Land Supply has led to another successful Appeal by a developer. This means that the Inspector has followed national guidelines, which state that there should be a presumption in favour of development where there is no Local Plan in place.

"We can only hope that the Cheshire East Local Plan is approved soon by the Inspector now that the Inquiry has restarted."
