This is an update of the story that appeared late yesterday – just in case anyone missed it.

Today is the last day to submit online comments on Gladman's duplicate planning application to build 120 homes at Little Heath.

Only a few Audlem residents appear to have taken up Audlem Parish Council's plea to submit separate objections to the duplicate plan.

Just 198 records are logged for the second application against 195 for the first, suggesting the Parish Council appeal has failed to have much of an impact on village voters.

The failure could give Gladman a loophole to reject the objections should this second application go to an appeal

The Parish Council has been urging residents to submit their views on the new application (ref 13/3746N) just as they did for the old one so that there can be no potential for Gladman to raise any challenges about the process.

Although Cheshire East has copied across all comments made on the original application en bloc to the duplicate application it is not at clear they will be accepted should second application also go to appeal.

Parish councillors have noted slight differences between the two plans prompting fears this might leave Gladman a loophole with which to reject the council's transfer of original objections.

According to planning law all applications must be considered on their own merits and objections lodged against one application may not be accepted as objections to the second, even when the applications are exactly the same.

Developers are within their rights to lodge duplicate applications where the first has gone to appeal over non-determination, as happened in the Gladman case.

Duplicate application are primarily a technical measure to give the developers room to carry on negotiations over planning details even while the original plan goes through the appeal process.

But many planning experts advise that a council repeats all of the consultation processes it went through with the original application and that objectors re-submit their comments.

It is important that you include the case number 13/3746N and the location LAND WEST OF AUDLEM ROAD, AUDLEM, CHESHIRE in your comment and to include your own name and address.

Councils often set deadlines for comments on planning applications as they prefer them to be submitted as early as possible but the council will take into account any representations received up to the date it makes a decision.
