Just in case you have been frustrated by some of the local problems in Cheshire East fighting a Gladman planning applications – non-determination leading to an appeal, website problems, no finalised Local Plan – spare a thought for the people of Kirkbymoorside in North Yorkshire fighting a Gladman application for development.

Their local council, Ryedale DC, we are told, rolled over when faced with the threat of an Appeal against non-determination and voted through Gladman's second duplicate application.

So Gladman withdrew the appeal at short notice in early September. Planning officers said there were no grounds for refusal, as the council did not have 5-year land supply at that time, due to the Planning Inspector's meddling with the Local Plan Strategy's buffer figures, and so the Local Plan (now ratified) counts for nothing.

However the council's planning decision in favour of Gladman was six abstentions out of ten councillors, with two opposed, and of the two councillors who voted FOR the development, one voted against his own motion to refuse, as he pressed the wrong voting button. This was later admitted but too late. So the chairman voted along with Officers' recommendation and the Gladman application went through.

This was followed by a noisy extraordinary Council meeting – with 150 residents attending – failed to overturn the decision for fear of bankrupting the Council.

The result of this fiasco is a Judicial Review which is now being launched by two private individuals to have the decision revoked.
