Following an enquiry from a reader about the process for selecting a new Parish Councillor to fill the vacancy which has recently arisen on Audlem Parish Council, the Parish Clerk, Jean White, has kindly sent us the following information.

This is known as a "casual vacancy". The vacancy must be declared as soon as possible after written resignation is received. A notice is then displayed for 14 working days, giving the opportunity for ten electors to claim a poll. Notices were displayed in the village notice boards and on Audlem Online – the 14 days period ended on 26th January without such a claim having been received, so Cheshire East advised the Parish Council that it could co-opt.

There is no legislation to cover the way this should be done. In this instance, the Parish Council decided to advertise the vacancy as widely as possible – notice boards in the village, in the Post Office and newsagents and in the Public Hall. Also, of course, on Audlem Online.

The closing date for applications is Sunday 21st February and a decision will be made at the Parish Council meeting on 1st March. There is no requirement to consider candidates who where unsuccessful at a previous occasion. The new councillor will have to sign a declaration of acceptance of office before being able take his or her seat.
