Audlem Parish Council is delighted to report that the application for 20 houses at Bird's Nest, Audlem Road, has been refused by Cheshire East Council. Cheshire East's Planning Officer recommended refusal on the grounds that the proposed development is 'outside of the settlement boundary for Audlem as defined in the Audlem Neighbourhood Plan (ANP) 2016'. The site is in Open Countryside and 'would erode the rural character of the countryside and would undermine the ability of the community to shape and direct sustainable development in their area' contrary to a number of ANP, Crewe & Nantwich Borough Council and NPPF policies.

The Decision Notice (click here to see the notice in full) refers to 'the loss of a priority area of habitat which would have a significant adverse impact upon biodiversity', especially potential for damage to any grass snake population. Reference is also made to the 'overlooking of the rear garden area of the residential property known as Bird's Nest which would cause significant harm to the living conditions of the occupiers of the neighbouring property through loss of privacy.' CEC state that they gave the applicant 'the opportunity to submit amended plans to overcome these concerns; however the concerns have not been overcome'.

This is a very welcome decision. It is the first time Audlem's Neighbourhood Plan has been instrumental in the refusal of a planning application and vindicates all the work put into its development by the Steering Committee and the community as a whole.
