Cheshire East planning officers are backing a bid to lift restrictions on use of the cafe at Overwater Marina

An application to lift a ban on public use of the cafe is to be heard at a Cheshire East planning committee meeting on Wednesday.

Now a report to councillors recommends they approve the move despite objections from a number of neighbours.

The application seeks to lift the restriction that the cafe 'shall be for the benefit of users of boats at the marina only and not for use by the general public'.

Objections have been lodged by three households on the grounds that marina access should remain private for safety reasons; that commercial use is detrimental to the surrounding area and that restrictions on the original permission had not been adhered to.

There were also objections over noise, general disturbance and increased traffic in the area.

A report to the committee from planners says the principle of development of the marina at the site has already been accepted and that the main issues are the impact on the character and appearance of the open countryside, highway safety and neighbouring amenity.

It says that since the original application was approved the National Planning Policy Framework has been introduced which has a clear aim to support economic growth in rural areas.

This should include supporting the provision and expansion of tourist and visitor facilities in appropriate locations, the report adds. Local Plan policy also allows for development to promote the use of canals, councillors are told.

The report admits that the cafe/shop unit has been used in breach of the condition for several years but says this does not appear to have had a significantly detrimental impact on the surrounding area, on the surrounding businesses, on local amenities or highways.

Environmental Health has raised no objection and neither has the Strategic Highways Manager. The report recommends that councillors support lifting the ban.
