Yet another Cheshire East housing development has gone direct to appeal for non-determination.
Time ran out over outline plans by Wainhomes Ltd to build 40 houses off Audlem Road, Nantwich, near Brine Leas School.
The plan went before Cheshire East's Strategic Planning Board last week but it was announced at the meeting that developers had lodged an appeal.
Cheshire East councillors recorded a "mind to refusal" on the application anyway although the decision is meaningless in planning terms.
But councillors hope the 'refusal' will at least carry some weight with the appeal inspector who will eventually consider the case.
The Wainhomes' scheme joins 46 other planning appeals in the pipeline for Cheshire East Council including an appeal by Gladman Developments to build up to 120 homes on land off Little Heath, Audlem, which Cheshire East also failed to determine within the statutory 13 weeks.
